I examine the implications of stereotyping and its intersections with the political realities facing American Indian communities. Specifically, I examine the typification of Indian as ecologically noble savage, as both employed and refuted by environmentalists, through the lenses of cognitive and social psychological perspectives and then bring it within the context of a broader cultural critique. I argue that the noble savage stereotype, often used to promote the environmentalist agenda is nonetheless immersed in the political and ideological parameters of the (...) modern project. Finally, I reassert the right and, more importantly, the authority of Native American peoples to ultimately define for themselves their respective identities and destinies. (shrink)

Earth’s Insights is about more than indigenous North American environmental attitudes and values. The conclusions of Hester, McPherson, Booth, and Cheney about universal indigenous environmental attitudes and values, although pronounced with papal infallibility, are based on no evidence. The unstated authority of their pronouncements seems to be the indigenous identity of two of the authors. Two other self-identified indigenous authors, V. F. Cordova and Sandy Marie Anglás Grande, argue explicitly that indigenous identity is sufficient authority for (...) declaring what pre-Columbian indigenous environmental attitudes and values were. Exclusive knowledge claims based on essentialist racial-cultural identity, though politically motivated, are politically risky. They may inadvertently legitimate more noxious and dangerous racial-cultural identity politics and exclusion of those who identify themselves (or are identified by others) in oppositional racialcultural terms from full and equal participation in the political and economic arenas of the prevailing culture. Biologically, racial differences are entirely superficial; Homo sapiens is a single, homogeneous species. Contrary to Hester et al., ethnic conflict was common among pre-Columbian indigenous North American peoples. Other indigenous authors, among them McPherson, have found my comparison of pre-Columbian indigenous North American attitudes and values with the Aldo Leopold land ethic to be illuminating. I wish I had not said that pre-Columbian indigenous North American attitudes and values are “validated” by ecology, but rather that they and ecology are “mutually validating.”. (shrink)

Hannah Arendt's essays about the 1957 crisis over efforts of a group of youth, the “Little Rock Nine,” to desegregate a high school in Little Rock, Arkansas, reveal a tension in her vision of the “public.” In this article Aaron Schutz and Marie Sandy look closely at the experiences of the youth desegregating the school, especially those of Elizabeth Eckford, drawing upon them to trace a continuum of forms of public engagement in Arendt's work. This ranges from arenas (...) of “deliberative friendship,” where unique individuals collaborate on common efforts, to a more conflictual “public stage,” where groups act in solidarity to change aspects of the public world. While Arendt famously asserted in her essay “The Crisis in Education” that political capacities should not be taught in schools, it makes more sense to see this argument as focused on what she sometimes called the conflictual “public stage,” reflecting the experience of the Little Rock Nine. In contrast, Schutz and Sandy argue that Arendt's own work implies that “deliberative friendship,” as described in her essay “Philosophy and Politics” and elsewhere, should be part of everyday practices in classrooms and schools. : Catholic teaching has no moral difficulties with research on stem cells derived from adult stem cells or fetal cord blood. The ethical problem comes with embryonic stem cells since their genesis involves the destruction of a human embryo. However, there seems to be significant promise of health benefits from such research. Although Catholic teaching does not permit any destruction of human embryos, the question remains whether researchers in a Catholic institution, or any researchers opposed to destruction of human embryos, (...) could participate in research on cultured embryonic stem cells, or whether a Catholic institution could use any therapy that ultimately results from such research. This position paper examines how such research could be conducted legitimately in a Catholic institution by using an ethical analysis involving a narrative context, the nature of the moral act, and the principle of material cooperation, along with references to significant ethical assessments. Taking regular walks when living with Parkinson’s disease has beneficial effects on movement and quality of life. Yet, patients usually show reduced physical activity compared to healthy older adults. Using auditory stimulation such as music can facilitate walking but patients vary significantly in their response. An individualized approach adapting musical tempo to patients’ gait cadence, and capitalizing on these individual differences, is likely to provide a rewarding experience, increasing motivation for walk-in PD. We aim to evaluate the observance, safety, tolerance, (...) usability, and enjoyment of a new smartphone application. It was coupled with wearable sensors and delivered individualized musical stimulation for gait auto-rehabilitation at home. Forty-five patients with PD underwent a 1-month, outdoor, uncontrolled gait rehabilitation program, using the BeatWalk application. The music tempo was being aligned in real-time to patients’ gait cadence in a way that could foster an increase up to +10% of their spontaneous cadence. Open-label evaluation was based on BeatWalk use measures, questionnaires, and a six-minute walk test. Patients used the application 78.8% of the prescribed duration and enjoyed it throughout the program. The application was considered “easy to use” by 75% of the patients. Pain, fatigue, and falls did not increase. Fear of falling decreased and quality of life improved. After the program, patients improved their gait parameters in the six-minute walk test without musical stimulation. BeatWalk is an easy to use, safe, and enjoyable musical application for individualized gait rehabilitation in PD. Accompanying this rediscovery of virtue is a criticism of modern ethical theories. In view of this ethical pluralism, certain philosophers have undertaken to set up ethical norms through reflection on justice, using the methods of discussion and decision prevalent in our democratic societies. The initiative has been designated as procedural ethics.2 In this rather chaotic situation, other writers have thought a return to Aristotelian ethics opportune-a move that would enable us to reconnect with the long tradition of virtue-based morality represented therein, while bringing it up to date. In fact, the introduction of the concept of virtue offers many opportunities for the shaping of a morality that takes the human person into account. Virtue is a dynamic human quality acquired through education and personal effort. It forms character and assures continuity in action. Furthermore, it is set within the framework of community and a strong tradition, to whose development it contributes. Teaching on virtue would seem to be a good corrective for excessive individualism. This is what the socalled "communitarian" trend has emphasized.3 The debate on virtue has also surfaced within traditional Catholic teaching. Since the first half of this century, under the inspiration of St. Thomas, several authors of moral theology textbooks have undertaken to reorganize special morality on the basis of the virtues rather than the ten commandments, as had been done since the seventeenth century.4 Admittedly, the change Aristotelian construct of the virtues held by Macintyre. Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by Nazi (...) Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. Few works have had the impact on contemporary philosophy exerted by Hegel's Phenomenology of Spirit. Twentieth-century philosophers in France were bound together by a reading of Hyppolite's translation and commentary. Sartre, Merleau-Ponty, Lacan, and Bataille were all shaped by Kojève's lectures on the book. Late twentieth-century philosophers such as Derrida, Lyotard, Deleuze, and Irigaray all operate against a Hegelian horizon. Similarly, in Germany Heidegger, Adorno, and Habermas developed their philosophies in large part through an engagement with Hegel. In the United (...) States the book has had a profound influence on feminism and gender studies. Thinkers as diverse as Butler, Benhabib, Mills, and Honig have developed political theories as well as theories of sexual difference by rereading Hegel's reading of Antigone. As Derrida suggests, this text must be read. It lays out the infrastructures and architectures of life in the modern nation state. It unfolds a grand narrative of the ways of thinking and acting that comprise human experience in "our time." The purpose of the text is to effect a transformation in readers, so that they cease to think of themselves as particular humans and come to know that their existence inheres in membership in a complex community-social, cultural, economic, religious, aesthetic, and political infrastructures that form the culture of possibilities in which self-consciousness emerges and is sustained. Rawlinson's reading reveals how Hegel's politics of the "we" is undermined both by his effacement of sexual difference and by his misappropriation of art as a "betrayal of substance." Both of these gestures discount specificity in favor of a generic subject and a mutual recognition in which the other is the same. She uses Hegel's own critique of abstraction against him to rethink the "we" as a community of difference, figured materially in the differentiated styles or signatures of art, and in so doing argues that that the task of phenomenology is never completed and that the abstract concepts of logic will always be dependent on phenomenology's productive or generative movement. In her reading Hegel is neither a metaphysician nor a subjective idealist. He is a phenomenologist, analyzing experience to articulate the ways in which humans generate narratives and material infrastructures to sustain the complexities of life. (shrink)

He cites a flattering portrait of him written by the Baroness of Hohenhausen and published in the morning press on March 22: "M. de Chateaubriand is of a somewhat short, yet slender, stature. (...) His oval face has an expression of reverence and melancholy. He has black hair and black eyes that glow with the fire of his mind." 1 At this point, Chateaubriand flatly adds: "Mais j'ai les cheveux blancs; j'ai plus d'un siècle, en outre, je suis mort" ("But I have white hair; I am more than a century old, besides, I am dead") [2:39]. 2 Of course, those startling words, "en outre, je suis mort" do not refer to the year 1821, nor to the time Chateaubriand is writing this account. Rather, they refer to the time we, readers, turn to this specific page of the Mémoires: as you are reading this, Chateaubriand reminds us, I am dead. Du simple devoir d’assistance dans des situations ponctuelles à des projets de transformation des conditions de vie animale à grande échelle, la défense de l’interventionnisme entre en conflit avec la pensée conservationniste qui valorise la naturalité ou l’autonomie des systèmes écologiques. Dans cet article, nous tentons de mettre en dialogue les intuitions interventionnistes et la pensée conservationniste. Nous (...) exposons tout d’abord l’argument interventionniste et ses limites épistémiques. Nous mitigeons ensuite le constat selon lequel les conditions de vie des animaux sauvages justifient notre intervention en replaçant le problème de la souffrance dans un cadre évolutif et écologique plus large puis en insistant sur d’autres obligations vis-à-vis des animaux sauvages comme le respect de leur autonomie ou de leur souveraineté. From a simple duty of assistance in particular situations to large-scale projects aimed at transforming animal living conditions, the defense of interventionism often conflicts with conservationist values, which emphasize the naturalness or autonomy of ecological systems. In this article, we attempt to open a dialogue between interventionist intuitions and the conservationist school of thought. We first expose the interventionist argument and its epistemic limitations. We subsequently mitigate the statement according to which the living conditions of wild animals justify human intervention by replacing the problem of suffering in a broader ecological and evolutionary framework, as well as by insisting on other obligations that we may have towards wild animals, such as the respect of their autonomy and sovereignty. Finally, we defend a pluralistic conception of our relationships to the natural world, in which care for animals has to be balanced with other, eco-centered, values. We conclude by presenting the resources of a compassionate conservation approach, which remains largely unexplored and integrates care for individual animals as well as for ecological entities in its norm for action. This article highlights Comte's ambivalence toward the sciences, which he otherwise celebrated as the foundation of positivism. It correlates changes in his attitude with his personal expériences as an ambitious scholar unable to find acceptance and legitimacy in the leading institutions of his time, especially the Académie des sciences. Comte remained a scientific bohemian, unable to adapt to the new trends of professionalization but eager to impose his moral vision on the scientific community that rejected him. Cet article souligne l'ambivalence (...) de Comte envers les sciences, qu'il a par ailleurs déclarées bases du positivisme. Il s'agit de mettre en relation ses changements d'attitude avec ses expériences personnelles, plus particulièrement avec son échec à se faire accepter et légitimer par les grandes institutions savantes de son temps, dont l'Académie des sciences. Comte est resté scientifiquement marginalisé, peu apte à s'adapter aux nouvelles exigences de la professionnalisation, mais très soucieux d'imposer ses conceptions morales à la société scientifique qui l'a rejeté. La vida entera de muchos ensayistas transcurre sin dar jamás con un tema. Este ensayo no sólo se topa con un tema, sino que incluso se da el lujo de aprovecharlo. El tema es la felicidad. Sin embargo, La herida de Spinoza es un libro de ?losofía, no de autoayuda. Parte de algunas conclusiones recientes de la neurología, en particular de las investigaciones de Antonio Damasio acerca de la impertinencia de la secular división entre mente y cuerpo. El propio Damasio (...) vincula sus investigaciones con las ideas que Spinoza expuso en su Ética. Para Damasio, la tranquila aceptación de la muerte, una de las señas de identidad de la ética de Spinoza –de hecho, la «herida» de Spinoza–, resulta «irritante». Ese comentario de Damasio parece inocuo, pero para Vicente Serrano no lo es, sino que apunta a una especie de «desajuste», a una extraña incomprensión de la diferencia última de la ética spinozista. A partir de ahí el autor no se propone criticar solamente esa y otras lecturas de Spinoza, sino que plantea además una amplia crítica a la modernidad, y también a la posmodernidad. La herida de Spinoza se convierte entonces en una revisión de la historia entera de la ?losofía en esa zona en que ética y metafísica (u ontología) se superponen. Aunque el proyecto parece apabullante, el autor se asegura de estar bien equipado. Por una parte suprime el aparato académico, lo que le permite ser más breve y directo, y por otra echa mano de una erudición notable y, sobre todo, de una capacidad absolutamente inusual de explicación. Si hubiera que buscar parangones a esa capacidad, no quedaría más remedio que acudir a Rüdiger Safranski. El autor, sin embargo, no hace biografías, ni siquiera historia de la ?losofía como tal, sino que intenta ?losofar de la mano de los más grandes pensadores de la historia. El ensayo se completa con la inclusión de una pieza maestra: los afectos. Los afectos serían la respuesta posible de la ?losofía al problema de la biopolítica. La progresión de la modernidad no sólo implica la desaparición de la naturaleza, sino la sustitución absoluta de los afectos por la voluntad (de voluntad). Si la vuelta a la naturaleza es imposible, e incluso indeseable –dado que la naturaleza no fue nunca más que una metáfora–, Serrano se inspira en Foucault para proponer una «vuelta» a los afectos como la pieza fundamental que cierra la reflexión sobre el poder. «Un ensayo en el sentido más ágil del término, obra a mitad de camino entre lo reflexivo y lo literario… Bien pensado y bien escrito, muchísimo más de lo que se ha vuelto habitual en nosotros» (Gabriel Albiac, Leer). «La cuestión de fondo teórica –a qué responde la religión y qué problemas de comprensión existencial atiende o atendía– es algo mucho más complejo y creo que más apasionante. El mérito principal de este libro es la audacia de la perspectiva escogida: la disyuntiva, por decirlo sumariamente, “entre Dios y la nada”. Fiel a ella, y elevándola a condición de eje hermenéutico, Vicente Serrano reconstruye los hitos fundamentales del proceso, atendiendo especialmente al propio Jacobi, pero también a los “grandes” del Idealismo Alemán, así como a Nietzsche, a Heidegger, a Michel Foucault, a las diversas teorizaciones “posmodernas” —o no— de los últimos tiempos. Es posible, en efecto, que haya más (...) teología en la filosofía contemporánea, allí donde su presencia lo es bajo la forma de una abrasadora ausencia, que allí donde se ofrece a rostro abierto… ese es, en cualquier caso, el desafío hermenéutico de este trabajo memorable. Alors que les notices de l'Avicenna latinus vont etre republiees, il a paru utile de rassembler ici les articles qui ont jalonne l'entreprise de recensement des manuscrits et qui en constituent comme la chair. Marie-Therese d'Alverny ne faisait pas seulement preuve d'une grande (...) erudition, elle savait aussi communiquer ses enthousiasmes et ses passions. Sans doute sous l'impulsion de Louis Massignon et Etienne Gilson - ses maitres et veneres amis - elle s'attacha a la personnalite et a l'oeuvre hors du commun d'Avicenne. (shrink)

L’article se propose d’explorer l’univers des facultés de droit sous la République de Weimar, que les contemporains jugent en « crise ». Cette perception renvoie tout d’abord aux difficultés d’adaptation d’un enseignement qui est de plus en plus écartelé entre les exigences de la science (transmettre une compréhension historique de l’évolution du droit) et celles de la pratique (préparer les étudiants au monde professionnel par une connaissance du droit en vigueur) : l’Université apparaît ainsi comme un lieu de confrontation entre (...) professeurs et autorités étatiques pour le contrôle du cursus juridique. Par ailleurs, dans un contexte de grande expansion des effectifs étudiants, les facultés de droit ne connaissent pas de démocratisation de leur public et restent le domaine des élites traditionnelles ; de ce fait, elles semblent en décalage avec leur époque et continuent de former un univers passéiste que conforte l’engagement des étudiants dans des corporations traditionnelles. The central theme of the volume is cultural diversity, a vast subject that is highly relevant today. The particular focus here is on the many ways in which this diversity is managed within the framework of State law. The twelve contributors to this book have a special interest in how cultural traditions and their various forms of expression are handled by the law. They were all participants in the 2009 Research Programme of the Centre for Studies and Research of the (...) Hague Academy of International Law. The breadth of the subject is reflected in the wide spectrum of perspectives from which the topic has been explored. Starting in each case from the existing State and international legal frameworks, the contributors explore how the interactions between positive law and other normative orders can be placed at the service of a legal system that is as fair as possible within a plural context. Contributors were asked to choose from two alternative approaches: either they could look at cultural diversity issues in the field of private (international) law, a fairly traditional field that is especially relevant to the legal treatment of cultural diversity; or they could situate cultural diversity within the wider and more theoretical area of "legal pluralism", whether on a local or regional level or at the international (United Nations) level. L’article se propose, à partir de l’expérience de la construction et de l’exploitation des bases de données dialectales de la BDLC (corse) et du THESOC (occitan), de cerner ce qu’un grand corpus est susceptible d’apporter à la phonologie. La réponse, appuyée sur quelques cas d’espèces, fait intervenir trois niveaux : celui de l’établissement des faits à soumettre à l’analyse, celui de la validation des hypothèses émises, celui de la valeur heuristique des données prises en compte. Les faits aléatoirement rassemblés dans (...) un grand corpus et donc non nécessairement pris en compte dans l’analyse initiale sont en effet de nature à transformer la vision de la clôture du corpus, à confirmer (ou infirmer ce qui, in fine, est aussi important) les hypothèses avancées, à suggérer d’autres solutions aux problèmes rencontrés que celles initialement envisagées. Un des points saillants, en outre, est, au plan théorique, la mise en discussion de la notion d’entité discrète, tant en matière d’unités phonologiques (de type phonème) que d’unités systémiques (de type idiome localisé) tant il est vrai qu’en matière de langue il n’existe qu’un continuum. L’idiolecte est déjà composite, l’idiome local n’est qu’un chaînon dans le continuum aréal. Les unités discrètes constituent donc l’instrument d’analyse incontournable du fait linguistique, une réalité dans la représentation qu’un locuteur a de son système ; mais l’observable est un continuum, un ensemble de cellules perméables les unes aux autres, si c’est bien dans la conscience collective que se trouve (déposée) la langue, conformément au dire saussurien.
